General Terms and Conditions of Sale

These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales of products offered by the company A&F, registered in the Trade and Companies Register of LISIEUX under the number 949754600, whose registered office is located at 82 rue des bains, 14360 TROUVILLE SUR MER, and concluded exclusively on the website www.pipelettesandco.com with consumers. They can be printed and retained by the Customer. Consequently, as soon as the Customer orders a product offered for sale on the website www.pipelettesandco.com, it entails full and complete acceptance of these General Terms and Conditions of Sale, which the Customer acknowledges having read beforehand. In accordance with Article L.111-1 of the Consumer Code, A&F provides the Customer with the following information:

PRODUCTS

The Customer is informed of the essential characteristics of the products they wish to order. The products offered for sale on the website www.pipelettesandco.com constitute the offer of A&F, which reserves the right to modify and change its collection and product ranges at any time. The photos of the products presented on the aforementioned site are not contractual. However, A&F ensures that the photos and drawings are faithful to the products offered, without any ambiguity regarding their characteristics.

CUSTOMER

A&F offers the sale of its products on the website www.pipelettesandco.com to consumers with the necessary legal capacity to place an order (hereinafter referred to as "Customer"). A&F cannot be held responsible for verifying the legal capacity of Customers.

PRICES

The sale price of products indicated in euros is the one in effect at the time of placing the order. These prices do not include shipping costs, which are charged in addition to the price of the products purchased according to the terms defined below as indicated to the Customer before order validation. The prices include VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The offers presented by A&F are valid as long as they are announced on the site within the limits of available stocks. The availability of products is visible on the site when placing the order. A&F reserves the right to change its prices at any time, however, the price listed in the catalog at the time of the order will be the only one applicable.

A&F offers you the possibility to order by the method of your choice to better satisfy you.

PAYMENT ON THE WEBSITE

For product purchases on the website www.pipelettesandco.com, A&F only accepts payments by credit card via the secure payment platform of Wix, which through the secure payment system of Wix Payments, STRIPE, or PAYPAL, secures your confidential information with a VeriSign SSL certificate. The information exchanged is thus encrypted with SSL (Secure Socket Layer) before being transmitted, and no one can use it without your knowledge. A&F therefore does not have access to the customer's banking information. A&F reserves the right to suspend or cancel any order and/or delivery in case of non-payment by the Customer, payment incident, and/or fraud in the use of the site or the payment method chosen by the Customer. Before validating their order, the Customer has the possibility to check the details, modify, or cancel it. Once the Customer confirms their order by clicking on the ["PAY"] icon, they are considered to have taken note and accepted the conditions of their order in full knowledge. The sale will be final upon confirmation of the order by the Customer, without prejudice to the exercise by the Customer of their right of withdrawal (see procedures below). This order will be confirmed by sending an email to the Customer summarizing all the information previously provided by A&F. A second email may be sent to the Customer upon shipment of their order. Both emails will be sent to the email address provided by the Customer when ordering. In case of input error of the concerned email address, or non-receipt of the order confirmation email, the responsibility of A&F cannot be engaged.

PRODUCT AVAILABILITY

A&F makes every effort to ensure product availability. Product offers are valid as long as they are announced on the site and within the limits of available stocks. Information on product availability is provided to the Customer at the time of the order. If a product in the order is not available at the time of preparation, A&F will automatically send an email to the Customer. The Customer can then:

  • Replace the out-of-stock product with a product of the same amount (except in the case of a free product);

  • Receive the rest of the order without the out-of-stock product, the amount will then be deducted from the total order and will not be charged to the Customer (except in the case of a free product);

  • Cancel the entire order.

LEGAL PRODUCT WARRANTIES

A&F complies with all its legal warranty obligations, such as the legal warranty of conformity provided for in Articles L211-4 and following of the Consumer Code and the warranty for hidden defects provided for in Articles 1641 and following of the Civil Code. In the event of a lack of conformity (goods not suitable for the usual use of a similar good, which do not correspond to the description given by the seller, or which do not have the qualities announced by the seller or agreed with you) or hidden defects (hidden defects of the sold item that render it unfit for the use to which it is intended, or which so diminish this use, that the buyer would not have acquired it, or would have given only a lesser price, if they had known about them) of the product and in compliance with the conditions set by law, you must first address your complaint to A&F by mail to the following address: A&F – 82 rue des bains, 14360 TROUVILLE SUR MER. In the event of non-conformity, A&F will replace the product with the same product or an equivalent product. The replacement will be made within a maximum period of one month from the receipt of the product.

JURISDICTION

Disputes or litigation that may arise between A&F and the Customer may be resolved by mediation/conciliation. Product sales on this site are subject to French law regardless of the Customer's country of residence or the place of the order. Any unresolved dispute between the Customer and A&F is subject to the exclusive jurisdiction of the French courts.
